Terms of Service
Effective Date: March 9, 2026
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NutriGuide AI ("we," "us," or "the Service"). By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must discontinue use immediately.
1. Definitions
- "Service" means the NutriGuide AI web application, its APIs, AI features, and all related documentation.
- "Guardian" means a parent, legal guardian, or authorized caregiver who registers and manages child patient profiles.
- "Pediatrician" means a licensed healthcare professional who uses the Service to screen, monitor, and manage patients.
- "Registered Nutritionist-Dietitian (RND)" means a licensed nutrition professional who uses the Service for dietary assessment and nutrition-care planning.
- "Child Account" means a limited-access account created by a Guardian for a minor to view their own health data under parental supervision.
- "Patient Data" means all health-related information entered into the Service, including anthropometric measurements, nutritional logs, consultation records, and AI-generated assessments.
- "AI Features" means any functionality powered by artificial intelligence, including but not limited to nutritional assessments, meal plan generation, food image analysis, compliance analysis, and the conversational AI assistant ("Nuri").
2. Description of Service
NutriGuide AI is a pediatric nutritional screening, surveillance, and decision-support platform designed to assist guardians and healthcare professionals. Core functionality includes:
- Anthropometric data recording with automated WHO Z-score computation and nutritional status classification
- Longitudinal growth tracking with percentile charting
- AI-powered nutritional assessments, culturally sensitive meal planning, and dietary recommendations
- Food image scanning and nutritional analysis
- Consultation management, screening workflows, and management plan generation
- Automated surveillance alerts for nutritional status changes
- Reporting and compliance monitoring
3. Eligibility and Account Registration
3.1 Age Requirement
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create a Parent/Guardian, Pediatrician, or RND account. Minor users may only access the Service through a Child Account created and supervised by their Guardian.
3.2 Account Responsibility
You are solely responsible for all activity under your account. You must maintain the confidentiality of your credentials and notify us immediately of any unauthorized access. We are not liable for losses arising from unauthorized use of your account.
3.3 Accurate Information
You agree to provide truthful, current, and complete information during registration and to keep your profile updated. We reserve the right to suspend accounts that contain materially inaccurate information.
4. User Roles and Obligations
4.1 Guardians
Guardians may register child patients, record measurements, log meals, access AI recommendations, and create supervised Child Accounts. By registering a child or entering child health data, you represent that you have legal authority to act on behalf of that child, that you have provided any notices and obtained any informed consents required by applicable law, including where required for AI-assisted analysis, daily compliance monitoring, and cross-border processing, and that you will use the Service only for the child's lawful care, supervision, or healthcare coordination as described in our Privacy Policy.
4.2 Pediatricians
Pediatricians may screen assigned patients, conduct consultations, create management plans, and generate clinical reports. By selecting the Pediatrician role, you represent and warrant that you are a duly licensed healthcare professional authorized to practice in your jurisdiction. You are independently responsible for obtaining and documenting any patient consent, guardian authorization, notice, or other legal basis required to use the Service in your clinical workflow, including where required for AI-assisted analysis, daily compliance monitoring, and cross-border processing. We reserve the right to request verification of licensure.
4.2A Registered Nutritionist-Dietitians (RNDs)
RNDs may access nutrition-care workflows, dietary assessments, meal-planning tools, and related reports for connected patients. By selecting the RND role, you represent and warrant that you are a duly licensed nutrition professional authorized to practice in your jurisdiction and to process patient information for nutrition-care purposes.
4.3 Child Accounts
Child Accounts provide limited, read-oriented access to a child's own dashboard, growth data, and AI assistant. Guardians are responsible for monitoring their child's use of the Service and ensuring it is appropriate. Child Accounts cannot modify clinical data, access other patients' information, or use features restricted to adult roles.
5. Medical Disclaimer
IMPORTANT: NutriGuide AI is a screening, surveillance, educational, and decision-support tool ONLY. It is NOT a medical device unless separately stated, does NOT provide medical diagnoses, prescriptions, treatment orders, or emergency triage, and is NOT a substitute for professional medical care.
- All AI-generated assessments, Z-score computations, nutritional classifications, alerts, meal recommendations, conversations, and simulations are for informational and screening purposes only and must not be construed as clinical diagnoses, therapeutic advice, or standing medical orders.
- Results and recommendations must be independently reviewed and validated by a qualified healthcare professional before any clinical decision, medication or supplement change, feeding restriction, or dietary intervention is made.
- Outputs depend on the user-input data and records available at the time. Missing, incomplete, stale, or inaccurate measurements, logs, and notes can materially alter or degrade the usefulness and safety of outputs.
- The Service does not replace professional medical judgment, physical examination, laboratory testing, differential diagnosis, or any standard of clinical care.
- In case of a medical emergency, contact your local emergency services immediately. Do not rely on the Service for urgent health situations.
- We do not assume a duty to monitor patient data in real time, escalate cases, contact emergency services, or intervene in urgent situations.
- Although we design product safeguards to promote beneficence and non-maleficence, including caution around incomplete data and elevated-risk situations, we do not warrant that harmful, unsuitable, or incomplete outputs will never occur.
- No physician-patient relationship is created between you and NutriGuide AI or its operators through use of the Service.
6. AI-Generated Content
6.1 Nature of AI Outputs
The Service uses third-party artificial intelligence models to generate nutritional assessments, meal plans, food analyses, and recommendations. By using AI Features, you acknowledge and agree that:
- AI outputs are probabilistic and may contain errors, inaccuracies, omissions, or contextually inappropriate suggestions.
- AI outputs are generated from user-input data and records available in the Service at the time. If those inputs are incomplete, inconsistent, stale, or missing, the resulting output may be incomplete, conservative, or inappropriate.
- AI recommendations are based on general nutritional guidelines (including WHO Child Growth Standards) and may not account for individual medical conditions, food allergies, drug interactions, metabolic disorders, or cultural dietary restrictions beyond those explicitly provided.
- Daily compliance scores, reminders, and deviation alerts are estimates derived from logged behavior and configured targets; they do not independently establish adherence, clinical improvement, beneficence, or absence of harm.
- You must not rely solely on AI-generated content for healthcare, dietary, or clinical decisions.
- We may use prompts, rules, and safety layers intended to operate cautiously when data is incomplete, but those safeguards cannot recreate missing clinical facts or substitute for clinician review.
- We do not guarantee the accuracy, completeness, timeliness, or fitness for purpose of any AI-generated content.
6.2 Third-Party AI Providers
AI Features are powered by third-party providers (currently OpenAI). Patient context transmitted to these providers is limited to what is necessary to generate relevant outputs. These providers operate under their own terms and privacy policies, and we cannot guarantee how they process data once received.
7. Data Accuracy and User Responsibility
You are solely responsible for the accuracy, completeness, and legality of all data you enter into the Service, including patient profiles, anthropometric measurements, meal logs, and consultation notes. Inaccurate input data will produce unreliable assessments and recommendations. We disclaim any liability arising from decisions based on inaccurate user-provided data.
8. Acceptable Use
You agree that you will not:
- Use the Service for any purpose other than pediatric nutritional screening, surveillance, and health management as intended.
- Enter false, fraudulent, or intentionally misleading patient information.
- Access, attempt to access, or tamper with data belonging to other users or patients not assigned to you.
- Circumvent, disable, or interfere with access controls, authentication mechanisms, or security features.
- Use automated scripts, bots, or scrapers to access the Service or extract data.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service in violation of any applicable law, regulation, or professional code of conduct.
- Redistribute, resell, or sublicense access to the Service without prior written consent.
9. Data Governance and Health Data Responsibilities
9.1 Sensitive Medical Data
Patient Data is sensitive health information. You must handle it using standards of confidentiality, security, and professional care appropriate to medical data. You may access, upload, export, or share Patient Data only for authorized care, supervision, or healthcare operations permitted by law and these Terms.
9.2 Guardian and Healthcare Provider Obligations
Guardians and Pediatricians are independently responsible for ensuring that their use of the Service complies with all applicable healthcare, privacy, child protection, and professional conduct requirements in their jurisdiction. This includes obtaining and documenting any necessary informed consent, guardian authorization, or other lawful basis before entering, reviewing, sharing, or acting on patient information in the Service.
9.3 Platform Controls and Regulatory Status
NutriGuide AI implements role-based access control, encrypted data transmission (HTTPS/TLS), secure authentication, and audit logging. However, the Service is provided on an "as-is" basis and has not been independently certified for compliance with HIPAA (United States), GDPR (European Union), or any specific national health data regulation unless expressly stated in a separate written agreement.
9.4 No Business Associate Agreement
Use of the Service does not constitute a Business Associate Agreement (BAA) under HIPAA or equivalent arrangement under other regulatory frameworks unless a separate written agreement has been executed between you and NutriGuide AI.
10. Intellectual Property
The Service, including its source code, algorithms, user interface design, visual assets, documentation, and proprietary AI integrations, is the exclusive property of NutriGuide AI and is protected by applicable intellectual property laws. No license, right, or interest in any of our intellectual property is granted except the limited right to use the Service in accordance with these Terms.
You retain ownership of the data you input. By using the Service, you grant us a limited, non-exclusive license to process your data solely to deliver and improve the Service as described in our Privacy Policy.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUTRIGUIDE AI, ITS OPERATORS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any medical decisions, health outcomes, or adverse events arising from or related to the use of the Service, AI-generated assessments, or recommendations.
- Errors, inaccuracies, or omissions in AI-generated content, Z-score calculations, or nutritional classifications.
- Loss, corruption, or unauthorized access to data, regardless of cause.
- Service interruptions, downtime, or unavailability.
- Any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
In no event shall our total aggregate liability exceed the greater of fifty United States dollars (USD $50) or the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless NutriGuide AI and its operators, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any data you submit to the Service; or (e) any medical or health decisions based on information obtained through the Service.
14. Service Availability and Modifications
We strive to maintain the availability and performance of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, updates, infrastructure issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
15. Termination
15.1 By Us
We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or pose a risk to other users or the integrity of the Service.
15.2 By You
You may terminate your account at any time through the Settings page or by contacting us. Upon termination, your right to use the Service ceases immediately.
15.3 Effect of Termination
Upon termination, we may retain your data as required by applicable law or legitimate business purposes (such as fraud prevention and regulatory compliance). Sections 5, 6, 11, 12, 13, and 17 survive termination.
16. Changes to These Terms
We may revise these Terms at any time. Material changes will be communicated at least thirty (30) days in advance through the Service, email notification, or both. Your continued use of the Service following the effective date of revised Terms constitutes your acceptance. If you do not agree with the revised Terms, you must discontinue use and terminate your account.
17. Dispute Resolution
17.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us to attempt to resolve any dispute informally. We will make good-faith efforts to resolve the matter within thirty (30) days.
17.2 Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is incorporated, without regard to its conflict of law provisions.
17.3 Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis, and not in a class, consolidated, or representative action.
18. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and NutriGuide AI regarding the Service.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or internet infrastructure failures.
